Practice Areas and Legal Definitions

Avandia Litigation:
Avandia is an oral anti-diabetic medication used to treat type 2 diabetes. It works by helping to stabilize blood-sugar levels; and does so by making the body more sensitive and receptive to the effects of insulin. Since Avandia was approved in 1999, the FDA has been monitoring several heart-related adverse conditions based upon data reported in previous clinical trials of Avandia alone and in combination with other drugs – some of these conditions reported included fluid retention, edema and congestive heart failure.

In May 2007, the FDA released a statement advising that information obtained via clinical trials – and published in the New England Journal of Medicine – had revealed a significant increase in the risk of heart attack in those patients to whom Avandia had been prescribed. The trials demonstrated that Avandia has the potential to increase the possibility of heart attack by 43%, and may increase fatalities from general heart disease by 64%.

A paper that appeared in the November 24, 2008 issue of Archives of Internal Medicine described the experiences of nearly 30,000 diabetic patients over the age of 65. Of those patients, 49.7 per cent had been prescribed Avandia and 50.3 per cent had taken another drug: Actos. One year later, 1,869 of the patients had died. Studies demonstrated that in those patients who had been prescribed Avandia, the rate of death was 15-per-cent higher than in those prescribed Actos.

Serious limb fracture has also been attributed to Avandia: In April 2008, the Archives of Internal Medicine published the conclusions of a study undertaken by researchers from Switzerland who had been studying British patients with diabetes.

Significantly, it was determined that in those patients who had been prescribed Avandia for at least twelve months, the possibility of suffering a bone fracture was nearly double that of those who did not take the drug. More disturbingly, in patients who had treated their diabetes with Avandia for at least two years, bone-fracturing levels had almost trebled.

If you have been injured as a result of taking Avandia, you may have the right to monetary damages including reimbursement for medical expenses, any loss of income, pain and suffering, and even punitive damages if special circumstances can be proven.
