Alan R. Brayton

Founding and Senior Partner; United States Air Force Academy (B.S. Economics, 1971), University of California at Los Angeles (M.S. Finance, 1972), Boalt Hall, University of California, Berkeley (J.D. 1976).
With over twenty–eight years of experience, Al Brayton is recognized as one of the West’s leading attorneys representing injured individuals and their families in all types of personal injury, products liability and mass tort litigation. He also enjoys a national reputation as one of the foremost attorneys representing victims of asbestos–related disease and has represented clients from virtually every state.
He has been recognized by the Consumer Attorneys of California for his particular experience as a Trial Lawyer in the areas of Products Liability and Professional Negligence. He has successfully tried and settled numerous cases involving victims of mesothelioma and other asbestos–related diseases, products liability, medical malpractice and personal injury, and has handled and argued cases involving a wide range of issues before the California Supreme Court and Courts of Appeal and various Federal Courts. Under his leadership, Brayton Purcell has become one of the premier trial firms in the western United States.
Born and raised in Northern California, Mr. Brayton graduated from Shasta High School in Redding, California before attending the United States Air Force Academy in Colorado Springs, Colorado. He was commissioned a second lieutenant upon graduation, and spent the next twelve years on active duty in the USAF, serving in a variety of jobs both in the United States and overseas, including seven years as a Judge Advocate. Upon leaving the Air Force he entered private practice in Novato, California, concentrating initially on asbestos litigation and aviation cases.
Early in his career, Mr. Brayton won one of the first asbestos cases ever tried in San Francisco Superior Court, and he successfully tried the first asbestos case in Solano County. He has been instrumental in the development of General Orders that govern the conduct of asbestos litigation in various counties throughout the State of California.
Although most of his time is currently dedicated to asbestos litigation, he also has extensive experience in defective medical device litigation and other toxic tort litigation. He has served as Plaintiffs’ Statewide Coordinating Counsel in California cases involving defective Temporomandibular Joint (TMJ) implants, served as plaintiffs’ co–counsel in Hawaii TMJ litigation, and has served on the TMJ Plaintiffs’ Steering Committee in the nationwide Multidistrict Litigation (MDL) “In Re TMJ Implants Products Liability Litigation.” He has negotiated key settlements in cases involving beryllium exposure and beryllium lung disease in plantworker and end–user cases across the United States. He has also served as lead counsel and settled various consumer class actions involving a wide range of problems ranging from altered medical vaccines to rent control abuses.
He also has extensive experience working with asbestos Bankruptcy Trusts, and currently serves as Chair of the Trust Advisory Committee for several Trusts involved in providing compensation for current and future asbestos victims. He recently served as Co–Chair of the Unsecured Creditor’s Committee in the Chrysler Bankruptcy, and was appointed by the Bankruptcy Court and currently serves as Litigation Manager for litigation stemming from this bankruptcy.
In addition to supervising the firm and working as a trial lawyer, Mr. Brayton has served on the Board of Governors of the Consumer Attorneys of California and reviews and comments on proposed legislation that affects consumer rights and access to the justice system. He has testified before Congress on behalf of asbestos victims to oppose industry efforts to relax stringent asbestos control standards and has been an invited speaker at a symposium on asbestos–related disease sponsored by the University of California at San Francisco Medical School. He also has been an invited speaker at numerous legal conferences on topics involving asbestos litigation, bankruptcy and trial advocacy. Mr. Brayton is an active member of and Past President of the Public Justice Foundation, a nonprofit organization that supports Public Justice, a national public interest law firm dedicated to protecting people, the environment and access to the courts. Mr. Brayton continues his involvement by serving on the organization’s Board of Directors, Executive Committee and Case Evaluation Committee.
An active member of the American Bar Association, Mr. Brayton has held various leadership positions in the Tort Trial & Insurance Practice Section. He has served as the Chair of the Plaintiffs’ Involvement Task Force and on the Task Force on Strategic Alliances as well as various committees, and has served on the Section’s Leadership Council. He has also served as Co–Chair of the ABA Asbestos Task Force and as a mentor and Course Director of the National Trial Academy, and has been honored with the ABA’s Pursuit of Justice Award for his tireless efforts in securing access to justice. He is a member of the American Association for Justice, the American Trial Lawyers Association, the Consumer Attorneys Association of Los Angeles, the Marin County Trial Lawyers Association, the San Francisco County Trial Lawyers Association, the Bar Association of San Francisco and the Marin County Bar Association. Gilbert L. Purcell

Born in Texas, raised in Oklahoma, Gil Purcell relocated to California in 1971 when Chevron closed its Midwest offices and his family moved to San Francisco. He attended Mt. Diablo High School in Concord, California where he was Valedictorian of his 1976 class. In 1979 Mr. Purcell attended Pembroke College at Cambridge University, studying International Economics and Courts before returning to UCLA to complete his B.A. in Economics. He studied law at Pepperdine University Law School, clerking for famed trial lawyers, Girardi & Keese in Los Angeles and was a founding member of a mid–sized plaintiffs firm with trial lawyers Federico Sayre (former founding partner with legendary trial lawyer Melvin Belli) and Raymond Boucher. He tried his first asbestos case in 1986 before California Supreme Court Chief Justice Ronald M. George. After achieving a sizeable verdict, and one of the first verdicts against the John Crane Packing Company, he was asked to return to the Bay Area and try asbestos cases for Steve Kazan, founding and senior partner of Kazan, McClain, Lyons, Greenwood and Harley, PLC in Oakland.
It was through this trial work that he met current partner, Alan Brayton. Before relocating to the Bay Area, Mr. Purcell tried to verdict the first successful asbestos property damage action in California against W.R. Grace & Co., manufacturer of asbestos–containing spray–applied fireproofing, obtaining the first of several multimillion-dollar verdicts. In that case, Mr. Purcell represented the owners of a 32–story condominium building in downtown Los Angeles and had many current and former Superior Court Judges and prominent attorneys as clients.
Widely regarded today as the premiere asbestos trial lawyer - Mr. Purcell has tried more cases to verdict, and has been more successful in obtaining verdicts for victims of asbestos disease, than any other attorney in the United States. His trials span the western United States (Washington, Oregon and Utah) and throughout California (Alameda, Los Angeles, Solano, San Francisco, Sacramento, Orange, Riverside, Ventura, San Bernardino and Contra Costa counties). In addition to numerous mesothelioma, asbestos lung cancer and asbestosis trials, Mr. Purcell tried the very first asbestos-related non-Hodgkin’s lymphoma cases in Washington and Oregon, as well as asbestos related colorectal cancer case in California.
He has argued multiple successful appeals before the California Supreme Court, the California Court of Appeal, the Utah Supreme Court and in Federal Courts involving complex asbestos, tobacco, shipyard and railroad–related FELA/BIA/Preemption on various personal injury issues.
Mr. Purcell has testified before the California Legislature on behalf of the Los Angeles Community College District addressing the injustice of limitations running against public entities barring pursuit of remedial asbestos cost recovery litigation. He continues to serve on various legal committees of the Consumer Attorneys of California where he has served on the Board of Governers for over fifteen years.

Mr. Purcell was admitted to California Bar in 1984 and is also admitted before the U.S. Supreme Court; U.S. Court of Appeals, Ninth Circuit; U.S. District Courts, Northern, Eastern, Central and Southern Districts of California; District of Columbia, Court of Appeals. He is on the Board of Directors and Board of Governors for the Consumer Attorneys of California; and a member of the American Association for Justice (former Acting Chair, AAJ Railroad Law Section). He is also a member of the Consumer Attorneys Association of Los Angeles, Public Justice, and the American Bar Association. Mr. Purcell became the youngest member of the American Board of Trial Advocates (ABOTA) to achieve the designation of diplomat in 2008.

David R. Donadio

Mr. Donadio was raised in Concord, Massachusetts, where he graduated in the top 10% of his high school class. In 1985 he graduated with a bachelor’s degree in philosophy from the University of Pennsylvania.
After moving to California, Mr. Donadio went to the University of San Francisco Law School (USF), where he was president of the Environmental Law Society. After graduating from USF, Mr. Donadio spent a summer clerking for the White House’s Council on Environmental Quality and obtained a masters degree in law, with a concentration in environmental law, from Vermont Law School.
Mr. Donadio began work with the Novato, California office of Brayton Purcell in 1991 as a law clerk and an associate immediately after his admission to the California Bar. His responsibilities included case management, law and motion, and all phases of discovery. In January 2000, Mr. Donadio became a junior partner. He is responsible for overseeing the day to day operations of associate attorneys and paralegals in both the Novato and Los Angeles offices.
Mr. Donadio is admitted to the California Bar; U.S. Court of Appeals, Ninth Circuit; and the US District Court, Northern District of California. He is a member of Consumer Attorneys of California and Public Justice. Mr. Donadio and his wife live in Novato, California.
Lloyd F. (“Butch”) LeRoy

Junior Partner; United States Air Force Academy (B.S. International Affairs, 1971); Vanderbilt University School of Law (J.D. 1979). Mr. LeRoy graduated from the U.S. Air Force Academy and was commissioned a Second Lieutenant. After service as an aircraft maintenance officer, he was competitively chosen to attend law school. He went to Vanderbilt University School of Law in Nashville, Tennessee where he was a member of the editorial board of the Vanderbilt Journal of Transnational Law. He was also selected for membership in the Order of the Coif. After graduation, and before joining Brayton Purcell, Mr. LeRoy was on active duty as a Judge Advocate in the United States Air Force. He retired with the grade of Colonel.
Mr. LeRoy supervises the firm’s Appellate Department. In that role he directs one of the busiest appellate practices in the state. In addition to choosing issues for appeal, writing and editing briefs, and ensuring timely compliance with court rules and deadlines, he appears and argues in the appellate courts on behalf of the firm’s clients. Mr. LeRoy is licensed to practice law in California and is an Appellate Specialist certified by the Board of Legal Specialization of the State Bar of California. He is also admitted to practice before the United States Court of Appeals for the Ninth Circuit and the federal District Courts for the Northern District of California and the Central District of California.
Mr. LeRoy is a member of the Public Justice, the Consumer Attorneys of California, and the American Bar Association. He has been married to his wife, Margie, for over 30 years. They have a daughter Jennifer, who is a freelance writer. Mr. LeRoy lists his hobbies as travel, reading, sports and “long walks with my bride.”
James P. Nevin Jr.

A San Francisco Bay Area native, James Nevin received a bachelor of arts from Boston College, a master of arts from Stanford University, and a law degree from University of California Los Angeles (UCLA), where he was an editor on the UCLA Law Review.
Mr. Nevin is a trial counsel with the firm. He has been with Brayton Purcell since March 2002. His legal practice focuses on toxic torts, such as tobacco and asbestos, and other civil litigation for plaintiffs. In 2004, Mr. Nevin was a student at the ABA/TIPS/ABOTA National Trial Academy held at the National Judicial College, and in 2007, he returned as a member of the faculty. Mr. Nevin is a regular speaker at conferences, seminars, and other CLE events. In 2010, Mr. Nevin was honored as one of the Forty Under Forty Leading Professionals by the North Bay Business Journal. In 2009 and again in 2011, he was selected for inclusion in Super Lawyers. In 2011, Mr. Nevin became the youngest associate member of the American Board of Trial Advocates (ABOTA). His prior legal experience includes work as a law clerk for the Washington State Court of Appeals. Before entering the legal field, Mr. Nevin lived in China, where he studied Mandarin Chinese and taught advanced English and U.S. history and political science.
Mr. Nevin is admitted to practice in California, including the 9th Circuit Court, the California Supreme Court, and all U.S. District Courts in the state. Hugh C. Cook

Hugh Cook graduated from the University of California at Riverside with a bachelor’s degree in English and a minor in political science. He attended the San Francisco School of Law. After graduation, he worked in the areas of employment, personal injury, and environmental law in Oakland, CA.
Mr. Cook joined Brayton Purcell as an associate attorney in March, 2000. His legal interests include asbestos, tobacco, employment and environmental law. He also manages our Investigations Department, which conducts client interviews as well as researches the different brands, manufacturers and suppliers of asbestos products and the contractors that used them in the presence of our clients. Mr. Cook is responsible for meeting with and informing potential new clients of the legal process and what is to be expected when pursuing an asbestos case.
A member of the California bar, Mr. Cook is also licensed to practice before the United States Court of Appeals for the Ninth Circuit. He belongs to Public Justice and the Consumer Attorneys of California. Mr. Cook’s hobbies include spending time with his family, fishing, golf, softball, and coaching children through the Boys and Girls Club and Little League organizations in Petaluma, CA. A jury in Salt Lake City, Utah found in favor of Vickie Warren, suffering from a rare case of peritoneal mesothelioma, in her products liability design defect and products liability failure to warn trial against Georgia–Pacific, LLP, Hamilton Materials, Inc., and Union Carbide Corporation. San Francisco Jury Awards Over $11.5 Million in Asbestos Case
A jury awarded over $1.1 million to a Navy veteran suffering from asbestosis and $400,000 to his wife for the loss of his companionship. The defendant, Asbestos Corporation Limited, acted with malice or oppression, according to the jury, which added another $10 million in punitive damages against the company.

San Francisco Jury Awards $33.7 Million to Former Navy Electrician
In what is believed to be the largest verdict ever in a California asbestos case, a San Francisco jury awarded a total of $33.7 million to a navy electrician and his wife. Mr. Todak, who suffers from mesothelioma, was awarded $22.7 million and his wife received $11 million for loss of consortium.
